TERM OF USE

By interacting with Give Kindly Online, you agree that you have read, understood and agreed to the Give Kindly Terms of use and agree to be subject to the following additional terms:

  • Give Kindly has a number of policies, including the Give Kindly Privacy and Security Policy and the Give Kindly Refund Policy. You agree that you have read, understood and agreed to the terms of each of these policies prior to making a purchase through the Give Kindly online platform.
  • Give Kindly does not share identifiable customer information with any charities, including those charities that Give Kindly supports.
  • In the case of round up donations and registry donations, only a unique identifier and donation for accurate reporting purposes are shared with the Charity. This means that as a customer, you will not be able to obtain a tax deduction or tax invoice from the charity.

REFUND POLICY

Thank you for shopping with Give Kindly. We hope that you're pleased with your order. If for any reason you're not fully satisfied, you can return any purchase within 7 days of receipt.

When you purchase an item from Give Kindly, Give Kindly charges your credit card and passes on payment, less the portion dedicated to charity, to the Give Kindly accounts department. 

Every purchase made through Give Kindly includes a percentage(%) which is donated to charity (Charitable Amount). The Charitable Amount is not refundable under any circumstances. The Charitable Amount is explained further here.

To secure a refund equivalent to your initial purchase price less the charitable donation, requires that you request a refund via the Give Kindly Refund Request Form.

If a refund is necessary, such as when you return an item, it is your responsibility to request that refund. We provide you with instructions on how to create refunds.

Refunds are typically processed by Give Kindly within thirty days of your request. If your refund satisfies the refund criteria, the funds will be deposited back in your debit/credit card account which you used to purchase the product and Give Kindly will send you confirmation of the refund by email.

Eligibility for Refund

We offer free returns for 7 days from the date of purchase. However, not all items are eligible. Any exclusions are listed below and/or are listed as non-refundable checkout. Our returns policy can be found below:

  1. As long as the return is initiated in your Account and the return is placed in the post within 7 days of receipt of the order confirmation email;
  2. Items must be unworn and unused and in a saleable condition with the original tags still attached;
  3. Items must be returned in the original packaging, which must be in the original condition, including sealed boxes, branded dust bags and shoe boxes (you don’t need the clear plastic packaging, except for products sealed for hygiene reasons - see below); and
  4. Items have not been specifically excluded from the change of mind returns policy, such as non-refundable items marked below or products marked as ‘Final Sale’ items on our online platform.  The exclusion will be noted on the relevant product page on our Site and/or at checkout.

Charitable Amount

Every purchase made through Give Kindly includes a % which is donated to charity (Charitable Amount). The Charitable Amount is not refundable under any circumstances. 

PRIVACY & SECURITY

Give Kindly values the trust that our customers, associates, representatives and service providers place in us when they give us personal information. We believe that privacy is more than an issue of compliance and endeavour to manage personal information in accordance with our core value of respect for the individual.
By:

  1. clicking “Yes” on our Privacy Policy pop-up or any web form referring to this Privacy Policy on any of our online Platforms, or
  2. submitting your Personal Data to us when signing up for an account on the Website or App, or
  3. browsing our Website or App, or 
  4. ordering any of our products and services

you are agreeing to the terms of this Privacy Policy.


What Does This Privacy Policy Cover?

This Privacy Policy describes what personal information we collect, how we collect and use your personal information, who we disclose it to and why, the measures we take to protect your personal information, and the choices you may have regarding our use of your personal information. It covers our Give Kindly online Platform in the United States including our website and mobile apps and services where this Privacy Notice is posted (“Sites”).


What Personal Information Do We Collect?

Give Kindly may collect or receive the categories of personal information listed below, which may depend on the products or services you may use, as well as your device and account settings. Not all categories of personal information will be collected or received about every individual.

  • Basic Personal Identifiers, such as name, telephone number, physical address, email address, government-issued identifiers (e.g., national identification numbers, driver’s license numbers), and signatures
  • Device and Online Identifiers, such as account login information, Mac address, IP address, cookie IDs, mobile ad IDs, and social media information
  • Internet and Other Network Activity Information, such as information about your browsing or search activity as well as your interactions with our websites, mobile applications, emails, or advertisements such as keystroke patterns (these tell us if it is you who is interacting with us, or a bot)
  • Commercial Information, such as purchase and transaction history information (such as products or services you have purchased, rented, or returned), product reviews, travel and vacation information, and sweepstakes and contest entries
  • Communications: Communication details (such as the content of emails, text messages, or other communications), call logs, and calendar information, where Walmart is a party to the exchange
  • Demographic Information, such as age, gender, citizenship, ethnicity, date of birth, family or marital status, household income, education, professional and employment information, family health, number of children, number of cars owned, and software or virtual assets owned
  • Financial Information, such as credit or debit card numbers, and financial account numbers
  • Biometric Information, such as voice prints, imagery of the iris or retina, face geometry, and palm prints or fingerprints
  • Geolocation: Data about the location of your device, which may be imprecise (i.e., inferred from your device’s IP address). If you provide your consent, this data may be precise. 
  • Sensory Information: Audio, visual information, and other sensory information such as photographs and audio and video recordings
  • Inferences: Individual preferences and characteristics, such as inferences drawn from and related to shopping patterns and behaviors, intelligence, and aptitudes

How does Give Kindly collect Personal Data from you? 

We collect Personal Data from you when:

  1. You register an account on the Give Kindly Website or the Give Kindly App;
  2. You use any of our related services, such as subscribing to our newsletter or product notifications;
  3. You browse our products and services or otherwise interact with our Website and Apps;
  4. You accept our cookies and other tracking technologies on your device;
  5. You interact with our customer service team or other representatives, for example, via our webform, chat, emails, telephone calls, letters, or face-to-face meetings;
  6. You interact with us on our Social Media, such as liking our posts, commenting on our posts, private messaging us on our Social Media;
  7. You sign up to our affiliate marketing partner network;
  8. You sign up to be a vendor selling to Give Kindly, 
  9. You purchase a gift card for redemption on Give Kindly platforms
  10. You participate in our promotions and giveaways, initiatives or any request for additional Personal Data such as customer surveys;
  11. We consult publicly available sources of information, or receive references or referrals from marketing and business partners, Related Companies, and third parties, for example, where they referred you to us to enjoy the benefits of a joint promotion or collaboration or to redeem a voucher you purchased through them;
  12. Your authorised representative submits your Personal Data to us for any purpose reasonably authorised by you, for example if such representative is purchasing our product or service to be delivered to you or as a gift;
  13. Our third-party analytics and other service providers, business or commercial partners provide your Personal Data to us, which was collected and processed by them and disclosed to us pursuant to their separate privacy policies; or
  14. You voluntarily submit your Personal Data to us for any reason.

We do not directly collect your credit card details to process your payment or for customer service purposes.  Your credit card details are collected, processed and stored directly by our third-party payment processors pursuant to their terms of use and privacy policies.  None of your credit card details are permanently stored with us.  However, we may collect your bank account details to process refunds.
We may use and disclose your Personal Data for purposes necessary to provide you with our products as services, including to:

  1. provide, maintain, protect and improve our technology, products and services, and monitor their effectiveness;
  2. register and maintain your user account and to verify your identity or age;
  3. process your order for our products or services, process or collect your payment for the order;
  4. deliver or perform the products or services you purchased, including couriers calling or messaging you to obtain your delivery instructions;
  5. facilitate you transacting via alternative payment methods (such as Paypal or Afterpay); 
  6. process your returns or refunds in accordance with our Terms and Conditions;
  7. provide you with supporting services and functions related to your user account, such as saved items in cart, wish-list, brand or product and browser notifications;
  8. communicate with you in relation to (i) your queries, requests and feedback, (ii) material changes to our Website and Apps Terms and Conditions, Privacy Policy or other terms and conditions, and (iii) matters relating to the operation of your account via the applicable or appropriate medium including email, SMS, or communicating with you at the telephone number you provide;
  9. personalise and improve your customer experience when you visit the Website and the Apps, for example by prioritising products and services appearing in your search results or feed, or in communications we send you;
  10. monitor and enforce compliance with our Terms and Conditions, including dispute resolution;
  11. to carry out administration, marketing, planning, account security, fraud detection and loss prevention activities, procurement, product and service development, quality control and research to improve the way we provide products and services to you;
  12. comply with (i) internal risk controls, (ii) the terms of our access to payment processing, financial or banking services such as credit card disputes, fraud, billing errors, or (iii) any applicable law, regulation or regulator’s directive; and
  13. ensure our Website and Apps function properly and to improve their performance, by carrying out activities such as debugging, statistical analyses for optimising our Website and Apps.

  1. send you marketing communications in relation to our sales, products, services, promotions or the Platforms;
  2. send you marketing communications in relation to the sales, products, services or promotions of business partners, including promotional mail together with your order;
  3. deliver ads that are related to our products and services that are targeted and personalised to your interests, attributes, preferences and experiences on the Platforms or other websites, apps or online platforms;
  4. enable businesses to deliver ads which are related to their products and services which may be of interest to you;
  5. provide you with any add-on or premium services;
  6. invite you to our private customer events;
  7. process your participation in our promotions and giveaways (including contacting you if you win, displaying your details online, publishing your name in relevant newspapers or disclosing details of winners to relevant authorities, if required by law), initiatives or any request for additional Personal Data such as customer surveys;
  8. process your participation in our business partners’ loyalty or point redemption programs;
  9. conduct market and customer research, analysis or tracking;
  10. promote our products and services on our Platforms;
  11. manage the administrative and business operations of Give Kindly and complying with internal policies and procedures;
  12. improve your customer experience across all touchpoints and training our customer experience team, such as by recording and monitoring phone calls; 
  13. any specific purpose in relation to a particular product or service, which we may separately notify you on the product or service page; and
  14. as part of or in anticipation of a business sale, merger, consolidation, investment, change in control, transfer of substantial corporate assets, reorganisation, liquidation, or similar business transaction or corporate event.

We may also use or disclose your Personal Data for secondary purposes in accordance with Applicable Laws, or with your further consent.   

Finally, we may also collect information about you in an aggregated and anonymous basis - in order to conduct internal analysis of traffic patterns within our Website. This information is used by us to administer and improve our education and training products and services.
